Learned AGA has argued that the stage of examining validity of the sanction is during trial and placed reliance on C.B.I. vs. Ashok Kumar Aggarwal, 2013 Law Suit (SC) 1178, Criminal Appeal No.1838 of 2013. It has further been argued that the entire procedure has been followed and sanction was filed in time but due to some error it was modified and later on modified sanction was filed.
