In support of her contentions, relied on the decision of
the Hon'ble Supreme Court in Gujarat State Financial
Corporation v. Natson Manufacturing Co. Pvt. Ltd.
and others [1979 (1) SCC 193]. She would thus contend
that the First Appellate Court had correctly appreciated
the facts and law on the point and had given liberty to
the Kerala Financial Corporation to proceed with the
same. It is further contended that even if the sale in
favour of the 1st defendant/ appellant in R.S.A
No.1189/2011 is upheld, even then, the prior charge
over the property by virtue of equitable mortgage cannot
be ignored by them.
