State Of Ap & Ors vs Goverdhanlal Pitti on 11 March, 2003

Hon'ble Apex Court in the case of State of A.P. V. Goverdhanlal Pitti Pitti (2003) 4 SCC 739 has held that if an act is done wrongfully, willfully without reasonable or probable cause, although not necessarily from ill feeling or spite, such an act in disregard to the rights of others clearly constitutes malice in law. It is further ther held that where malice is attributed to state authority it is not a case of personal ill will or personal spite on the part of the state rather it is a malice in legal sense which can be described as an act which is taken with an oblique or indirect object.
