In Kunhikayyumma and another v. Union of India
and others (AIR 1984 KERALA 184), it was held that if
from the facts and circumstances of the case sufficient
cause for the delay in seeking substitution of the
legal representatives of the deceased party was obvious
the Court would be justified in granting the relief
ignoring the fact that the affidavit neither mentioned
the cause nor prayed for setting aside the abatement.
