4.3. With regard to the CCTV footage, it is submitted that the
same could not be secured as the storage capacity of the CCTV
system installed in the police station was limited to one month.
By the time the interim direction was issued by this Court, the
footage had already been automatically overwritten. He further
submits that the decision of the Hon'ble Supreme Court in
Paramvir Singh Saini v. Baljit Singh (AIR 2021 SC 64), which
mandates installation and preservation of CCTV footage in police
stations for a longer period, was rendered subsequently, and at
the relevant point of time the system did not maintain data for six
months. Therefore, it is contended that no adverse inference can
be drawn against the respondent police authorities. In view of the
above circumstances, it is submitted that there is no material on
record to establish any illegal act on the part of the respondent
police authorities and hence the petition is liable to be dismissed.
