Learned advocate for the appellants has relied on AIR 2016 SC 3006
(State of Jammu and Kashmir vs. R.K. Zalpuri & Ors.) for the proposition that
delay or laches is one of the factors which should be borne in mind in the
exercise of discretionary powers under Article 226 of the Constitution and the
High Court may refuse to invoke its extraordinary powers if there is negligence on
the part of the writ petitioner to assert his right, resulting in prejudice to the
opposite party.
