In Ganesh Shet (supra), the Supreme Court had examined the principles of law applicable to suits of specific performance in regard to the discretion which is to be exercised under Section 20 of the Specific Relief Act when there is a conflict between the pleading and the evidence and in this context observed that while normally It is permissible to grant relief on the basis of what emerges from the evidence even if not pleaded provided there is no prejudice to the opposite party, but such a principle cannot be applied in suits relating to specific performance.
