55. The Supreme Court in the case of Ram Narain v. State of Punjab , has held that if there is inconsistency between the medical evidence and the prosecution version then the medical evidence should be accepted.

56. The same view has been expressed by the Apex Court in the case of Lakshmi Singh v. State of Bihar . At paragraph 14 of that decision at page 2270 (of AIR): (at p. 1743 of Cri LJ), the Supreme Court has observed as under :-

57. Again in the case of Niranjan Prasad v. State of Madhya Pradesh reported in 1996 Cal Cr. LR (SC) 169 : 1996 Cri LJ 1987, the same view has been expressed by the Apex Court where the Supreme Court has held, inter alia, that ocular testimonies in disagreement with the medical evidence then sustenance of conviction is impossible.
