45. Conclusively, in light of the foregoing, it is
reiterated that from the material placed on record and arguments
addressed on behalf of the State, complainant as well as that on
behalf of the accused, it is reiterated that in the considered
opinion of this Court, the prosecution has not been able to prove
its case/charge under Section 302 IPC, 'beyond reasonable
doubt' against the accused, namely, Vinod Kumar. On the
contrary, in light of the various lacunae and material omissions,
as hereinunder observed, benefit of doubt in the considered
opinion of this Court, must necessarily enure in favour of the
