this court considered a similar controversy where certain applications
regarding executability of the decree were part heard by the Court and the

petition and applications were listed on the subsequent date before another
Bench, which dismissed the execution petition.

This Court referred to the
decision in Deutsche Ranco GmbH (supra) and the decision of the Supreme
Court in Damodaran Pillai and Ors. (supra) and inter alia held that since
the execution petition itself had not been set down for hearing, the order
dismissing the execution petition for non-prosecution could not be treated as
an order under Order XXI Rule 105(2) of the CPC.
