23. Learned counsel for the Respondent has also placed reliance on the
Judgment of the Apex Court in N. G. Projects Limited vs. Vinod Kumar Jain
and Ors (supra). In the said Judgment, the bid had been rejected for not
furnishing the requisite Bank Guarantee. In the present case, the Petitioner
did submit the Bank Solvency Certificate dated 21.06.2021 which is about

six months prior to the date of the floating of the tender i.e. 28.01.2022 and
that does not mean that the Bank Solvency Certificate could not have been
looked at all.
