In the said Judgment, the bid had been rejected for not furnishing the requisite Bank Guarantee. In the present case, the Petitioner did submit the Bank Solvency Certificate dated 21.06.2021 which is about Signature Not Verified Digitally Signed By:HARIOM SINGH KIRMOLIYA W.P.(C) 8635/2022 Page 17 of 18 Signing Date:03.09.2022 16:12:01 six months prior to the date of the floating of the tender i.e. 28.01.2022 and that does not mean that the Bank Solvency Certificate could not have been looked at all.
