With regard to judgment in case of Somesh
Tiwari Vs UOI [(2009) 2 SCC 592] relied upon by the
applicant, it is submitted that the employee in the said case
was transferred even nothing adverse had been found
against him in the investigation on an anonymous complaint
against him, while in the present case, the applicant has
been transferred due to administrative reasons and in public
interest and, therefore, this judgment is also not applicable
to the present case of the applicant.
