In the case of DHARMA NAIKA Vs. RAMA NAIKA AND
ANOTHER - (2008) 14 SCC 517, the Apex Court was dealing
with a case of an Agreement of Sale which had been executed
before the commencement of PTCL Act and in that regard,
the Apex Court took the view that the sale would not render
Section 4(1) inapplicable. In the instant case, as the
Agreement of Sale itself stipulated that the proposed transfer
would happen on the Government granting permission for
transfer, the question of parties being in violation of law
would not arise.
