18. The learned counsel for the appellant has relied
on a decision reported in (2010) 1 SCC (Cri) 917 in the
case of Gangula Mohan Reddy vs State of Andhra Pradesh,
wherein the Hon'ble Apex Court adverting to several earlier
decisions, has observed that there has to be clear mens rea
to commit the offence, but in the instant case, there is no
clinching evidence to prove the mens rea on the part of the
accused for instigating the deceased to commit suicide.
