In the said case WP.
No.1244/15 (Yogendra Yadav vs. State of M.P. and others), in the
first round, the learned Single Judge opined that the petitioner therein
has shown a higher degree of valiancy in comparison to the person
with whom parity was prayed for. By giving such specific finding,
the respondents were directed to reconsider the case of the petitioner
therein for promotion on out of turn basis. The respondents rejected
the said claim by stating that it does not have any merit. Certain
findings were given for rejecting the claim which run contrary to the
order passed by the learned Single Judge. This Court after taking
