41. The learned counsel for the plaintiff has submitted his
arguments on clarification and he has relied upon the decisions in
2023 LiveLaw SC 865 in Sheo Raj Singh (Deceased) through LRs
& Ors. Vs Union of India & Ors. - It is held that
"Limitation Act 1963 : Sec.5 - Condonation of delay - a
liberal approach should be taken regarding delay in
appeals filed by the State. Delay - a court of appeal
should not ordinarily interfere with the discretion
exercised by the Courts below."
