C.K. Jaffer Sharief vs State (Thr C.B.I.) on 9 November, 2012
In
the said case, Hon'ble Apex Court had taken into
consideration all the previous laws on this subject,
including the case relied upon by Ld.Defence Counsel as
well as the law laid down in case titled "Prakash Singh
Badal vs. State of Punjab" reported as (2007) SCC 1
and in case titled "C.K.Jaffer Sharief Vs. State
(through CBI)" reported as (2013) 1 SCC 205. It was held
that for the purposes of considering the protection to a
public servant under section 197 Cr.P.C, in case the
alleged act raises mixed question of fact & law, then the
same cannot be considered at the stage of charge.
