8. Admittedly, the first charge sheet was filed
and subsequently, the further investigation was
conducted and thereafter, the final report has been
submitted. On going through the Section 173(8) of
Cr.P.C., it empowers the police to conduct further
investigation after filing of the report and the same has
been recognized and also accepted by the catena of
decisions of this Court as well as by the Hon'ble Apex
Court. It is also held by the Hon'ble Apex Court in the
case of Kari Choudhary v. Sita Devi reported in AIR
2002 SC 441 that the Investing Agency is not
precluded from further investigation in respect of an
offence in spite of forwarding a report under sub-section
(2) of Section 173 on a previous occasion. Wherein at
paragraph Nos.11 and 12 it has been observed as
under:
