Advocate for the petitioner has relied upon a decision of the
Hon'ble the Supreme Court in case of Uttar Pradesh State
Cooperative Land Development Bank Ltd. v. Chandra Bhan Dubey and
ors., reported
in 1999 (1) LLN 1081 and
in case of Ram Sahan Rai v. Sachiv Samanaya
Prabandhak and Anr., reported
in (2001) 3 SCC 323. In
the said case it is held that cooperative society is instrumentality
of State and the respondent company being a district cooperative
bank was held to be covered under the provisions of Article 12 of
the Constitution of India.
