In Damodar Das v. Lakhan Das (1910) ILR 37 C. 885 : 30 MLJ 624 (PC) the Privy Council held that where two chelas divided two institutions and the property among themselves one chela could not recover the property on the death of the other. Sir Arthur Wilson, who delivered the judgment of their Lordships observed at page 894:

In a recent case Phillips, J held that a permanent lesseee could not set up the bar of limitation in a suit for recovery of possession of the property by the trustee.
