30. On the other hand, Mr.A.L.Somayaji, the learned senior counsel
for the respondent, on the strength of the decision in OSSEIN AND GELATINE
MANUFACTURERS' ASSOCIATION OF INDIA v. MODI ALKALIES AND CHEMICALS LTD.
(A.I.R.1970 S.C.1744), would submit that in the present case, the hearing is
an institutional hearing and the decision to cancel the Certificate of
Registration is not taken by any designated official under the RBI Act, but
the Bank itself. The relevant observation of the Supreme Court in the said
decision is as follows:
