18. The Court is of the opinion that the disqualification of the Petitioners
would not be correct in these facts. This Court has also noticed in another
decision in W.P.(C) 2291/2025 titled The Chetak Cooperative Group
Housing Society Ltd & Anr. v. Registrar of Cooperative Societies & Ors.
dated 11th August, 2025 that the same Mr. Rastogi, who has been appointed
as the Returning Officer in the present case, ought not to be appointed as a
Returning Officer for conducting elections as there are several cases where
there are numerous allegations against him. The relevant portion of the said
