In the decision, Rangappa - Vs - Mohan
(AIR 2010 SC 1898), Hon'ble Supreme Court has
reconsidered this issue and clarified that, existence of
legally recoverable debt or liability is a matter of
presumption under section 139 of N.I.Act. In para 14 of
the Judgment the Hon'ble Supreme Court observed as
