In the case of Khadat Mazdoor Chetna Sangarh v. State of M.P. 1995 Cri.L.J. 508, the Hon'ble Supreme Court while referring to a case of Prem Shankar Shukla (supra) and to the case of Sunil Gupta v. State of M.P. , observed as under:
