The sweep of the
powers under Section 482 Cr.P.C reserved in favour of the High
Court to do justice in the facts of a given case is not fettered by
the stipulations of Section 320 Cr.P.C. I am satisfied that this is
an eminently fit case where such jurisdiction under Section 482
Cr.P.C as enabled by the dictum in Madan Mohan Abbot v.
State of Punjab must be invoked.

proposition that the powers under Section 482 Cr.P.C which
