For
coming to the aforesaid conclusion, the Supreme Court has relied on its previous
decision in the case of Samarendra Nath Sinha v. Krishna Kumar Nag, AIR 1967 SC
1440. It is also held in the said decision that the doctrine of lis pendens
applies irrespective of strength or weakness of the case on one side or other.
There is, however, one condition that proceedings must be bona fide. If
proceedings are bona fide, applicability of Section 52 of the TP Act was not
avoided.
