8.1 Thus,
a Division Bench noticed that the Full Bench of the Bombay High Court
had no occasion to consider the restrictions read by the Apex Court
expressly in paragraph 60 of the decision in the case of Liverpool
[supra] nor even an occasion to consider the matter of limitation
provided by Order 38 Rule 5 of the Code of Civil Procedure.
