19. However, the law has been laid down by the Hon'ble Supreme Court in the
judgment reported as "DHARMENDRA GOEL versus ORIENTAL
INSURANCE CO. LTD." III(2008) CPJ 63 (SC) that some depreciation has to be
given. The value of the car was Rs.2,20,000/- when it was got insured on
20.5.2008 but the car was burnt on 9.5.2009 i.e. about 10 days before the expiry of

the insurance period or to say that about a few days before the expiry of one year.
Therefore depreciation of 10% from the total value of the car was not improper.
