To substantiate his argument, Sri Ravindranath cited before me the reported decision of this Court in Sarojamma and Others v Shankar, on the point that readiness of tenant to effect necessary repairs at his own cost does not take away the operation of Section 44 of the Act, Om Prakash and Others v Ram Kumar and Others, on the point that unless a party seeks a relief, it was not available for a Court to grant that relief and lastly Mahaboob Saheb v V. Anjaneyulu, wherein the learned Single Judge of this Court held that a Court should not pass unintelligible order without applying its mind to the facts of the case.
