It has been held by Hon'ble
High Court of Delhi in Kali Charan @ Bachhu & Ors. v. State (Delhi
Administration) 1984 Chandigarh Criminal Cases 520 (HC) that mere presence of
some persons with arms at a place can not necessarily lead to inference that they had
designs to commit dacoity anywhere. At the most they can be charged for being in
possession of arms. Likewise, for offence u/s 399 IPC, prosecution has to prove some
overt act to show preparation for committing dacoity.
