This view must be held to have been rejected by this Court when it declared in Veruareddi Rmaranghava Reddy & Ors. v. Konduru Seshu Reddy & ors (1) (at p. 277) "In our opinion, S. 42 of the Specific Relief Act is not exhaustive of the cases in which a declaratory decree may be made and the courts have power to grant such a decree independently of the requirements of the section It follows, therefore, in the present case that the suit of the plaintiff for a declaration that the compromise decree is not CS SCJ NO. 2409/2023 VICKY AND ANR. VS. MCD AND ORS. PAGE NO. 9 OF 17 binding on the deity is maintainable as falling outside the purview of S.. 42 of the Specific Relief Act".
