3. Learned counsel for the appellant submits that though application was only for sand mining, EC has been granted for boulder, gravel and sand. 5. Even before issuing notice, the Project Proponent (PP), R-5, has entered appearance through Counsel to oppose the Appeal. We have heard learned Counsel for the PP accordingly. He submitted that the PP has given an undertaking that no mining will be done for boulder and gravel and thus mining is only for sand. With regard to replenishment study, it is submitted that it is not required. Our attentions has been drawn to order of the Hon'ble Supreme Court dated 11.11.2021 in I.A No. 29984 of 2021, Bajri Lease LoI Holders Welfare Society Through its President v. The State of Rajasthan & Ors., wherein referring to earlier judgement in Deepak Kumar v. State of Haryana1, it was observed:-
