H.Guruswamy vs A. Krishnaiah Since Deceased By Lrs on 16 August, 2021

12. We have observed that the counsel for respondents is taking the plea that the Tribunal ribunal had granted them the liberty on 18.02.1999 that they shall, however, be at liberty to make necessary enquiry into the allegations regarding their engagement on the basis of alleged lleged forged records and to take appropriate action in the matter in accordance with law. Since no time frame was fixed so they are at liberty to conduct this enquiry even after twenty years. This is preposterous. Hon'ble ble Apex Court has observed in the latest judgment in Civil Appeal NO. 317 OF 2025 (Petition for Special Leave to Appeal(C) No. 9719/2020) in the matter of H. Guruswamy & ORS. Appellant(s) Vs. A. Krishnaiah since deceased by LRs Respondent(s) dated 08.01.2025 that ".........the rules of limitation ion are based on the principles of sound public policy and principles of equity. No court should keep the 'Sword of Damocles' hanging over the head of a litigant for an indefinite period of time."
