12.2. In the instant case the plaintiff has, admittedly, not prayed for
consequential relief(s) such as recovery of possession, though he prayed for a
decree of permanent injunction. Thus, there appears to be force in the
submission of Mr. Mozumdar, learned counsel for the defendants. And the
decisions referred by him in Akkamma (supra) also supported his contention.
Now, the question is, whether possession of the suit land was handed over to
the defendants after execution of the alleged deeds, so as to seek such a
consequential relief for recovery of possession by the plaintiff.

13. This Court has also carefully considered the submission of Mr. Mozumdar,
learned counsel for the defendants in respect of applicability of Section 55(4)(b)
of the Transfer of Property Act, and also gone through the decision referred by
him in Vidhyadhar(supra). Section 55 of the Transfer of Property Act read as
