20. As rightly pointed out by Sri.Ashok
Haranahalli that the trial court had no opportunity
of applying the principles laid down by the Hon'ble
Supreme Court in THREESIAMMA JACOB AND
OTHERS case. The said judgment has been
rendered on 08.07.2013. Whether the said
judgment has application to the facts and
circumstances of the present case or not has to be
examined by the reference court only, after
considering the arguments of the State.
