9. We have gone through the judgment passed by
the Hon'ble High Court at Kerala, which has been
relied upon by the applicants in this O.A. The
Hon'ble High Court at Kerala held that the Writ
Petitioners belong Engineers Grade SD-SG. They
have been getting additional increment for
Scientists/Engineers covered under exhibit P-1 to
that Writ Petition. Exhibit P-1 is the order
issued by the Government of India with the sanction
of the Hon'ble President in exercise of powers
under Article 77 of the Constitution of India. It
did not say that the additional increment so
granted will not be considered as Pay. The Hon'ble
High Court at Kerala in the said judgment at
paragraph 5 held as follows :
