17. He further submitted that the learned Rent Control Appellate
Authority has not considered the maintainability of proceedings under
Tamil Nadu Buildings (Lease and Rent) Control Act properly, but
confirmed the order of eviction based on the ground of wilful default. The
question of law with regard to the maintainability of petition under Tamil
Nadu Buildings (Lease and Rent) Control Act can be raised first time even
in the appeal. It has been so held in the judgment of the Hon'ble Supreme
Court reported in (1979) 3 SCC 280 (Tarini Kamal Pandit and others
..vs.. Prafulla Kumar Chatterjee (dead) by LRs.).
