In M.G.Agarwal v. State of Maharashtra [AIR 1963 SC 200], a Constitution Bench of the Apex Court held that every primary fact constituting the circumstances based on which the prosecution proposes to establish the guilt of the accused, need not be proved beyond a reasonable doubt. Therefore, the circumstances proposed by the 2025:KER:34602 40 Crl.Appeal Nos.64 of 2008 and conn.cases prosecution need to be proved by the ordinary standard.
