26. The Hon'ble Supreme Court in K.A.Abdul Majeed vs. State
of Kerala and others, (2001 (6) SCC 292), made it very clear that
the seniority of an employee is to be determined by the date of first
appointment in the service. The Supreme Court held that the question
whether initial appointment was regular or not could not be considered
at the time of fixation of seniority.

(2010) 1 SCC 417, held that an employee cannot be given seniority
prior to his birth in the cadre.
