Mr. Joy Saha, learned Counsel appearing for the
respondent would rely upon the decision of the Apex Court

in the case of N.B.C.C. Ltd. vs. J.G. Engineering Pvt.
reported in 2010 AIR SC 640. In an identical situation, the
Apex Court affirmed the decision of this Court denying the
relief. Mr. Saha would contend, since there was no
provision in the Statute, the learned Judge was right in
dismissing the application that would not call for any
interference and in any event, the appeal itself is not
maintainable.
