15. The mandatory portion of Section 342 may be set out as follows: "For the purpose of enabling the accused to explain any circumstances appearing in the evidence against him the Court...shall...question him generally on the case after the witnesses for the prosecution have been examined and before he is called on for his defence." This is one of the general provisions as to inquiries and trials as stated in the title of Chapter XXIV of which it forms part. It has been held by this Court that it applies to trials before a Court of Session in spite of the word "if any" in Section 289: Emperor v. Raju Ahilaji and Emperor v. Savalya .
