12. The records show that the petitioner has not shown diligence in prosecuting the applications, though he has put forward a very substantial defence. Be that as it may, the issue regarding the locus standi of the person who has now been impleaded to represent the Trust is an issue which can be contested in the impugned appeal and this need not been an impediment to the petition being allowed.
