Prasad Sharma, reported in (31) 1964 CLT 295, wherein it is
held as under;-

He also relied upon another decision in the case of Bhanwar
Lal Vs. Smt. Kamla Devi, reported in AIR 1983 Raj 229,
wherein, Rajasthan High Court held that in the event, an
application for withdrawal of the Civil Proceeding and an
application under Section 24 of the Act are pending, learned
Court should consider the application under Section 24 of the
Act ahead of the petition for withdrawal of the Civil Proceeding.
It is further submitted that an earlier application for withdrawal
of CP was dismissed, but a subsequent application was
entertained and it was allowed to be withdrawn vide order dated
30th September, 2022. As such, the grievance of the Petitioner
can be adjudicated in the writ petition. He, therefore, prays for
setting aside the impugned order and to direct the Opposite
Party to pay pendente lite maintenance as prayed for.
