Suraj Lamp & Industries (P) Ld.Tr.Dir vs State Of Haryana & Anr on 11 October, 2011
Admittedly plaintiff has neither the GPA nor the Will of
the defendant in his favour. He has only the agreement
to sell Ex. PW1/2, receipt Ex. PW1/3 and affidavit Ex.
PW1/4 which do not convey any title in his favour qua
suit property. Even in view of law laid down by Hon'ble
Supreme Court in Suraj Lamp (Supra) the 'GPA sale' or
'SA/GPA/Will transfer' also do not convey title and nor it
can be recognized by a valid mode of transfer of
immovable property.
