In Muthu Kutty and another vs. State by
Inspector of Police, T.N. (2005) 9 SCC 113,
wherein their lordships have held that if the
person recording the dying declaration is
satisfied about the declarant's medical
condition, then such declaration will not be
considered invalid solely on the ground that the
doctor has not certified the condition of the
declarant. In this judgment, Hon'ble Supreme
Court considered the principles regarding dying
declaration and held that it can be sole basis
of conviction if it inspires full confidence of
the court.
