In the judgment relied upon by the appellant's counsel in the case of MATHEW OOMMEN vs. SUSEELA MATHEW reported in AIR 2006 SC 786, wherein it is held that there is no dispute regarding the principles enumerated in the above said decision that there was no requirement that scribe 27 cannot be an attesting witness. But, in the instant case, admittedly, scribe is not examined and PW2 is not a scribe and he has not seen the execution of the Will by Kempaiah. Hence, that judgment is not applicable to the facts of this case.
