10. We heard Ld D.R and perused the record. We notice that the Ld CIT(A) has
dismissed the appeal of the assessee by placing reliance on the decision rendered
by the Hon'ble Supreme Court in the above cited case, without examining the facts
available in the instant case. According to Ld A.R, the facts available in the instant
case are different from the one available in the case of Citizen Co-operative Society
ITA Nos.3172 to 3174/Bang/2018

(supra), considered by Hon'ble Supreme Court. We notice that the factual aspects
of the case have not been examined by assessing officer also.
