17- On account of procedure irregularities by the authorities, the Hon'ble Supreme Court in the case of Icchu Devi Vs. Union of India reported in (1980) 4 SCC 531 has set aside the detention under the COFEPOSA. In the case of Icchu Devi, there was an undue delay in supplying to her the copy of document and the material relied upon in the grounds of detention and there was unreasonableness, delay in considering the representation to the detenu.
