Relying upon the decisions of the Supreme Court in Alka Ojha vs. Rajasthan Public Service Commission & Ors., AIR 2011 SC 3547 and Bedanga Talukdar vs. Saifudaullah Khan & Ors., AIR 2012 SC 1803, learned counsel submitted that unless power of relaxation is duly reserved in the relevant rules and/or in the advertisement, the terms and conditions contained in the advertisement cannot be relaxed by this Court and thus, the learned Single Judge has seriously erred in extending the cut-off date for eligibility qualification prescribed under the advertisement to the date of counseling/verification.
