In Union of India vs. Tantia Construction Pvt. Ltd. (supra) Hon'ble Supreme Court has dismissed the SLP on the ground that an alternative remedy is not an absolute bar to the invocation of the writ jurisdiction of the High Court or the Supreme Court and that without exhausting such alternative remedy, a writ petition would not be maintainable. In the case of ABL International Ltd. vs. Export Credit Guarantee Corporation of India Limited (supra) the Supreme Court has considered the issue of maintainability of the writ petition involving disputed question of fact and grant of the monetary relief claimed by the petitioner.
